1. Acceptance of Terms

By accessing and using Lumi (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

What We Provide: Lumi is a personal AI memory layer that enables you to save, organize, and search conversations and insights across multiple AI tools.

Functionality: We provide cloud storage for your memories, semantic search capabilities, and integration with AI tools via MCP (Model Context Protocol) tokens.

Availability: The Service is provided on an "as available" basis. We target 99.9% uptime but do not guarantee uninterrupted service.

3. Acceptable Use

You agree not to use Lumi for:

•Storing illegal content or content that violates laws in your jurisdiction
•Storing other people's personal data without their explicit consent
•Attempting to access other users' data or compromising security
•Reverse engineering, scraping, or automated access to the Service
•Any activity that interferes with or damages the Service

4. User Accounts

Account Creation: You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities that occur under your account.

Responsibility: You agree to immediately notify Lumi of any unauthorized use of your account or any other breach of security.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep this information updated.

5. Privacy

Your use of Lumi is also governed by our Privacy Policy. Please review it to understand our practices.

6. Intellectual Property

Your Content: You retain all rights to the memories and content you create and store in Lumi. You grant Lumi a license to store, process, and transmit your content as necessary to provide the Service.

Our IP: Lumi and all its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Lumi, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

7. Service Availability

Uptime Target: We target 99.9% uptime but do not guarantee uninterrupted service. The Service may be unavailable for maintenance or due to circumstances beyond our control.

Maintenance: We will provide advance notice of planned maintenance when possible, but emergency maintenance may occur without notice.

No Liability: We are not liable for any damages resulting from service unavailability or interruptions.

8. Limitation of Liability

As Is Service: Lumi is provided "as is" without warranty of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

Liability Cap: To the maximum extent permitted by law, Lumi's liability for any damages arising from or related to this Service shall be limited to the total amount you have paid for the Service in the 12 months preceding the claim.

No Consequential Damages: In no event shall Lumi be liable for indirect, incidental, special, consequential, or punitive damages.

9. Termination

Your Termination: You may cancel your account and stop using the Service at any time. Your memories will be retained until you delete them or until 30 days after account deletion.

Our Termination: We may terminate or suspend your account for violations of these Terms of Service or for any reason, with or without cause. We will provide notice when possible.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflicts of law provisions. Any legal action or proceeding related to your access to or use of the Service shall be brought exclusively in the state and federal courts located in California.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you via email or by prominent notice on our website. Your continued use of the Service following such modifications constitutes your acceptance of the updated Terms of Service.
